  • Missed Call Protection: Automated SMS responses to missed calls, capturing customer information and booking appointments
  • AI Receptionist: Voice AI that answers calls on your behalf (available in select plans)
  • Customer Communication: Management of customer interactions via SMS and voice
  • Calendar Integration: Automated booking to your calendar system
  • Reporting: Weekly summaries of captured leads and interactions

SMS Messaging Terms

Service Description

By using our services, we will send transactional SMS messages to your customers on your behalf. These messages include:

  • Missed call follow-ups and responses
  • Appointment confirmations and reminders
  • Customer service communications
  • Job detail requests and confirmations

Message Frequency

Message frequency varies based on your business's call volume and customer interactions. Messages are sent only in response to customer-initiated actions or for appointment-related communications.

Opt-Out Instructions

Your customers can opt out of receiving SMS messages at any time by:

  • Replying STOP to any message
  • Replying HELP for assistance

After opting out, customers will receive one final confirmation message and will not receive further SMS messages unless they opt back in.

Message and Data Rates

Message and data rates may apply to SMS messages sent and received. These charges are determined by the customer's mobile carrier and are the customer's responsibility.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. While we use reliable SMS delivery services, we cannot guarantee delivery timing or success in all circumstances.

Consent Requirements

Consent to receive SMS messages is not a condition of purchase. You can use our services without SMS functionality if you choose.

User Responsibilities

You agree to:

  • Provide accurate business information and maintain up-to-date contact details
  • Use our services only for lawful business purposes
  • Comply with all applicable laws and regulations, including TCPA and A2P 10DLC requirements
  • Not use our services to send spam, unsolicited marketing, or illegal content
  • Maintain the security of your account credentials
  • Ensure you have permission to send messages to your customers

Pricing and Payment

Our pricing plans are clearly outlined on our website. By subscribing to our services:

  • You agree to pay the monthly subscription fee for your selected plan
  • 30-day free trial available for new customers with no credit card required
  • After the trial period, you will be charged the monthly fee unless you cancel
  • Payments are processed monthly in advance
  • All fees are non-refundable except as required by law

Cancellation

You may cancel your subscription at any time:

  • No contracts or long-term commitments required
  • Cancel through your account dashboard or by contacting support
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial months of service
  • You will retain access to the service until the end of your paid period

Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may temporarily suspend service for maintenance, updates, or due to factors beyond our control. We are not liable for any losses resulting from service interruptions.

Intellectual Property

All content, features, and functionality of Blue Caller Solutions' services are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without written permission.

Limitation of Liability

To the maximum extent permitted by law, Blue Caller Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, arising from your use of our services.

Indemnification

You agree to indemnify and hold Blue Caller Solutions harmless from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

Changes to Terms

Governing Law
